Data deletion rights by state

Updated September 2026 — we update this as new laws pass.

Your legal power to force data brokers to delete your information depends on where you live. Here's the honest map — and what HomeCloak does with it for you, automatically, wherever you are.

Tier 1 — One request deletes everything: California

California's Delete Act created DROP, a state-run platform where one verified request legally compels 500+ registered data brokers to delete your information within 45 days — even brokers that refuse every other kind of request. It's the strongest consumer privacy tool in America, and California is the only state that has it live today. HomeCloak customers in California get a guided walkthrough in their dashboard and can designate us as their authorized agent for follow-ups.

Tier 2 — Centralized deletion on the way: Connecticut

Connecticut has passed a law creating its own central data-broker deletion system, expected around 2028. The moment it goes live, Connecticut customers will get a guided walkthrough here, just like California's.

Tier 3 — Deletion rights, one request at a time: 19 states

These states have comprehensive privacy laws giving you the right to demand deletion from businesses holding your data — but there's no central platform, so you must send a request to each company one at a time:

California · Colorado · Connecticut · Delaware · Indiana · Iowa · Kentucky · Maryland · Minnesota · Montana · Nebraska · New Hampshire · New Jersey · Oregon · Rhode Island · Tennessee · Texas · Utah · Virginia

This is exactly the work HomeCloak automates: every removal request we send cites your state's law (and California's, which many brokers apply nationwide rather than keep separate rules for each state). One plan, every covered site, no forms.

Vermont, Texas, and Oregon also maintain public data-broker registries — useful for knowing who's out there, though removal is still site by site.

Tier 4 — Everywhere else: no state law yet

No comprehensive state privacy law, and no federal one yet either. You still have real leverage: most data brokers honor removal requests nationwide under their own published privacy policies rather than keep different rules for each state — and that's the leverage HomeCloak uses for every customer, in every state, today.

Whatever tier your state is in, the starting point is the same: see which sites are showing your home and your name.
